PROGRAM ITINERARY AND SPEAKERS 

The Class Action Wage and Hour Conference will feature presentations on a series of topics designed to appeal to advanced practitioners: (1) a summary of recent case law in this constantly expanding area of law, (2) a focus on recent trends in class certification, both from the perspective of seeking to obtain, and seeking to defeat, such motions; (3) a panel featuring judges from the complex panels of the Los Angeles and Orange County Superior Court, and (4) a panel examining issues that arise in the settlement of wage and hour class actions, including damage modeling and mediation tactics. This inaugural event promises to be a successful addition to the Section’s regular stable of offerings.

Case Law Update

Top plaintiffs'- and defense-side employment practitioners summarize the last year in review - an eventful one, in wage/hour law. The panelists will discuss major, conflicting decisions of the Courts of Appeal defining meal/rest period class action decisions, and preview the upcoming oral argument at the Supreme Court in Brinker v. Superior Court. Momentous decisions highlighted include the Martinez v. Combs decision affecting the scope of the definition of "employer" in wage/hour matters and cases discussing the scope of "kin care" and itemized wage statement (Labor Code 226) requirements. Among other topics, the panelists will further elucidate the state of arbitration class waivers post-Stolt-Nielsen v. AnimalFeeds and what courts are requiring for approval of wage/hour class settlements, post-Kullar v. Foot Locker.

Employment Law Wage and Hour Class Actions: Litigating Class Certification

John Barber, of Lewis Brisbois Bisgaard & Smith LLP, Kristen Fritz, of Marlin & Saltzman, LLP and Maria Rodriguez, of Winston & Strawn, LLP, will examine the latest developments and the newest techniques for prosecuting and defending wage-and-hour class actions, with a particular emphasis on class certification. The panel will focus on the certification process from start to finish, including procedural considerations, evidence, and legal arguments. In discussing these legal developments, the presenters will provide an update on current case law including the recent cases of AT&T Mobility v. Concepcion, Hernandez v. Chipotle Mexican Grill, Inc., Brinker Restaurant Corp. v. Superior Court, and Brinkley v. Public Storage.

Judges Emilie Elias, Anthony Mohr and Carl West of the Los Angeles Superior Court Complex Panel and Judge David Velasquez of the Orange County
Superior Court Complex Panel will highlight a presentation designed to enlighten practitioners on the judicial perspective on important topics such as approval or denial of class certification motions, approval or denial of class action settlements, and discovery disputes in the wage and hour context. This will be an invaluable opportunity to hear from the judges who routinely preside over complex wage and hour class actions.
